In this Customer Privacy Policy (Privacy Policy):

  • references to we, us or our means any subsidiaries and affiliated companies as amended from time to time of HotMyDog SRL. and any of our Franchisee Street Food Places in each case operating in countries outside Belgium including: France, Germany, Luxembourg, the Netherlands;
  • references to Franchisee Street Food Places means any eating places operated by a third party franchisee under the HotMyDog® Street Food Place brand;
  • references to you or your means the person accessing and using the Website (as defined below) and/or otherwise visiting a HotMyDog® Street Food Place;
  • references to the Website mean the following website found at (as amended from time to time): www.hotmydog.com;
  • and includes the HotMyDog app;
  • and references to HotMyDog® Street Food Place means any Street Food Place for the operation of HotMyDog® Street Food Places which specialize in the sale of fresh made Hot-Dogs, and other accompaniments prepared in accordance with our HotMyDog brand standards.

This Privacy Policy sets out the basis on which we collect and use personal information about you through your use of the Website and when you visit a HotMyDog® Street Food Place.

  • Customer satisfaction/feedback surveys: your views and opinions about your visit to a HotMyDog® Street Food Place and your dining experience as well as your views about the Website.
  • Technical Information: technical Information from any device you use in our stores Belgium.

  • LinkedIn; and
  • Snapchat.

In the course of using the Website and when you visit a HotMyDog® Street Food Place, you may provide us with personal information relating to third parties.

WHO MAY WE DISCLOSE YOUR PERSONAL INFORMATION TO?

We may share your personal information with:

  • Our group companies: other companies and entities that are part of the HotMyDog Group.
  • Our service providers: our business partners, suppliers and sub-contractors for the performance of any contract we enter into with you for example:

    • Dropbox;
    • Airtable;
    • Mailchimp;
    • Deliveroo;
    • Sumup;
    • Shopify.

  • Our professional advisers: including accountants, lawyers and other professional advisers that assist us in carrying out our business activities, a current list of these third parties can be provided to you on application to legal@hotmydog.
  • Our franchisees: these are individuals or organisations who enter into an agreement with us to operate a HotMyDog® Street Food Place under the HotMyDog brand in various jurisdictions all over the world. Your personal information will not be shared with all of our franchisees but only those that are relevant to you.
  • Social media related parties: wtb.agency, Belgium

We may also disclose your personal information to other third parties, for example:

  • in the event that we sell or buy any business or assets we will disclose your personal information to the prospective seller or buyer of such business or assets;
  • if we or substantially all of our assets are acquired by a third party (or are subject to a reorganisation within our corporate group), personal information held by us will be one of the transferred assets; and
  • if we are under a duty to disclose or share your personal information in order to comply with any legal obligation, or we are involved in any litigation with you.

SHARING WITH FRANCHISEES, THIRD PARTIES AND COMPANIES WITHIN THE HOTMYDOG GROUP

Where we act as an independent controller of your personal information we will use your personal information for our own purposes. Sometimes franchisees, third parties and other companies in the HotMyDog group will act as controllers of your personal information that we collect. This is where they determine the purposes and means of processing your personal information. They will use your personal information for their own legitimate purposes as described in their respective privacy notices. Please refer to their individual privacy notices for full information about how they collect and process your personal information. WHERE WILL WE TRANSFER YOUR PERSONAL INFORMATION?

We will process your personal information both within and outside the European Economic Area (EEA) (this includes the United States of America, as amended from time to time).

When we transfer personal information outside the EEA, we will implement appropriate and suitable safeguards to ensure that such data will be protected as required by applicable data protection law, for example we will seek to anonymise it. If we can't anonymise your personal information, we will take reasonable steps to ensure that your personal information is protected. To do this we may use a set of standard data protection clauses which have been approved by the European Commission in accordance with Article 46 of the GDPR. HOW LONG WILL WE KEEP YOUR PERSONAL INFORMATION?

We will retain your personal information for no longer than is necessary for the purposes for which the personal information are processed. The length of time we hold on to your personal information will vary according to what that information is and the reason for which it is being processed.

To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means. We also consider any applicable legal, regulatory, tax, accounting or other requirements which may specify how long we should retain your personal information for.

Subject to the above, personal information about our customers will be retained by us for seven years from, the date of your communication with us to allow us to:

  • respond to any queries or complaints you may have; and
  • fulfil our obligations to the relevant tax authorities depending on where you are resident and other relevant governing bodies.

We have put in place appropriate security measures to seek to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.
